1. Who we are and what these Terms cover

AIAutoPub ("the Service") is a social-media publishing platform operated by ALTINKEY, headquartered in Dubai, United Arab Emirates, with a regional office in Istanbul, Türkiye ("we", "us"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and accounts

• The Service is offered for business and professional use. By using it you confirm you act in the course of a trade, business or profession — for your own brand or for clients you are authorized to represent — and that you are at least 18 years old.
• You sign in with one-time codes sent to your WhatsApp number. You are responsible for keeping access to that number secure and for all activity under your account.
• Accounts and purchases are not available to persons or entities in territories subject to comprehensive international sanctions, or otherwise blocked by applicable sanctions lists.

3. The Service

The Service lets you build a brand profile, generate marketing texts and images with artificial intelligence, schedule recurring publishing plans, and publish — manually or automatically — to social accounts you connect (currently X, Telegram, Facebook Pages, Instagram, LinkedIn, Threads and TikTok; the set may change). Features may be added, changed or removed as the Service evolves.

4. AI-generated content

• Generative models can produce content that is inaccurate, incomplete or biased. You must review every post before it is published, including posts published automatically by plans you configured.
• Generated content is not legal, medical, financial or other professional advice.
• Some jurisdictions require disclosing that content is AI-generated. As the publisher of your posts, you are responsible for any disclosure duties that apply in your markets.

5. Your content and intellectual property

• You retain all rights in the material you provide (brand information, texts, images, logos) and you own the texts and images the Service generates for your projects, once generated.
• You grant us a limited operational license to store and process that material, to publish it on your behalf on the accounts you connect, and to use it in aggregated, non-identifying form to improve the Service.
• The Service itself — software, design, models' orchestration, trademarks — remains our property or that of our licensors.

6. Connected social accounts

• Connecting an account authorizes us to publish to it on your instruction (a publish click or a plan you created). We store the platform tokens encrypted and use them only for that purpose.
• You must have the right to use every account you connect and you must comply with each platform's own terms (Meta, X, Telegram, LinkedIn, TikTok and others).
• The platforms are independent third parties: they may change or limit their interfaces, reject content, or suspend accounts. We are not responsible for their decisions or outages.

7. Acceptable use

You must not use the Service to create or publish content that is unlawful, misleading, defamatory, infringing of others' rights (including intellectual property), or that impersonates any person or entity; nor to run abusive automated campaigns, spam, or attempts to circumvent the Service's quotas and technical limits. We may suspend or terminate accounts involved in such use.

8. Fees, tokens, expiry and refunds

• Paid features are billed through prepaid token balances. Feature prices in tokens are shown in the Service before each action and may change prospectively.
• Token packages are sold by our payment partner acting as merchant of record, which issues the invoice and handles applicable taxes. The package price, its validity period (if any) and the refund rule are displayed before purchase.
• Token balances are tied to the account they were purchased for and are not transferable between accounts and not redeemable for cash except as stated in the refund rule.
• Refunds: within 14 days of a purchase you may request a refund of the amount paid minus the value of tokens already consumed, valued at the regular (non-discounted) price. After 14 days purchases are non-refundable. Promotional or granted tokens have no cash value.
• Free allowances, trials and promotional grants may be modified or withdrawn at any time.

9. Availability

We aim for a reliable service but do not guarantee uninterrupted or error-free operation, and scheduled publishing depends on third-party platforms being available. Planned maintenance and incident recovery may cause temporary unavailability.

10. Privacy and data deletion

Our Privacy Policy describes what we store and why; Data deletion describes how to disconnect accounts and erase your data. Deleting your account erases your personal data rather than archiving it.

11. Termination

• You may stop using the Service and delete your account at any time from Settings.
• We may suspend or terminate accounts that materially breach these Terms, abuse the platforms, or create legal or security risk — with notice where reasonably possible.
• On termination, remaining paid tokens are handled under the refund rule in section 8; content already published on your social accounts is unaffected.

12. Disclaimers and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law. To the same extent, our aggregate liability arising out of or relating to the Service is limited to the amounts you paid us in the twelve (12) months preceding the event giving rise to the claim, and we are not liable for indirect, incidental, consequential or punitive damages, or for loss of profits, revenue, data or goodwill.

13. Indemnification

You will indemnify and hold us harmless from claims, damages and reasonable costs arising from the content you create or publish through the Service, your use of connected accounts, or your breach of these Terms.

14. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates. Any dispute that cannot be resolved amicably shall be finally settled by binding arbitration at the Dubai International Arbitration Centre (DIAC), seat Dubai, in the English language.

15. Changes to these Terms and language

• We may update these Terms; material changes will be announced in the Service or by message, and continued use after the effective date constitutes acceptance.
• These Terms are drafted in English with an Arabic convenience translation below; the English version prevails in case of any conflict.

1. من نحن وما تغطيه هذه الشروط

AIAutoPub («الخدمة») منصة نشر على شبكات التواصل تُشغّلها ALTINKEY ومقرّها دبي، الإمارات العربية المتحدة، ولها مكتب إقليمي في إسطنبول، تركيا («نحن»). بإنشائك حساباً أو استعمالك الخدمة فأنت توافق على هذه الشروط وعلى سياسة الخصوصية. إن لم توافق فلا تستعمل الخدمة.

2. الأهلية والحسابات

• الخدمة مقدَّمة للاستعمال التجاري والمهني. باستعمالك لها تقرّ أنك تتصرف في إطار تجارة أو عمل أو مهنة — لعلامتك أو لعملاء مفوَّض عنهم — وأن عمرك 18 سنة فأكثر.
• الدخول برموز لمرة واحدة تصل إلى رقم واتساب الخاص بك؛ أنت مسؤول عن تأمين الوصول إلى هذا الرقم وعن كل نشاط يجري بحسابك.
• لا تتاح الحسابات والمشتريات للأشخاص أو الكيانات في الأقاليم الخاضعة لعقوبات دولية شاملة أو المدرجة على قوائم العقوبات المعمول بها.

3. الخدمة

تتيح لك الخدمة بناء ملف هوية لعلامتك، وتوليد نصوص وصور تسويقية بالذكاء الاصطناعي، وإنشاء خطط نشر دورية، والنشر — يدوياً أو تلقائياً — على الحسابات الاجتماعية التي تربطها (حالياً X وتيليجرام وصفحات فيسبوك وإنستغرام ولينكدإن وثريدز وتيك توك، وقد تتغير القائمة). قد تُضاف مزايا أو تتغير أو تُزال مع تطور الخدمة.

4. المحتوى المولَّد بالذكاء الاصطناعي

• النماذج التوليدية قد تنتج محتوى غير دقيق أو ناقصاً أو متحيزاً. عليك مراجعة كل منشور قبل نشره، بما في ذلك المنشورات التي تنشرها الخطط التي أعددتَها تلقائياً.
• المحتوى المولَّد ليس نصيحة قانونية أو طبية أو مالية أو مهنية.
• بعض التشريعات توجب الإفصاح عن أن المحتوى مولَّد آلياً. بصفتك ناشر منشوراتك، واجبات الإفصاح المنطبقة في أسواقك تقع عليك.

5. محتواك والملكية الفكرية

• تحتفظ بكل حقوقك في المواد التي تقدّمها (معلومات العلامة، النصوص، الصور، الشعارات)، وتملك النصوص والصور التي تولّدها الخدمة لمشاريعك بمجرد توليدها.
• تمنحنا ترخيصاً تشغيلياً محدوداً لحفظ هذه المواد ومعالجتها ونشرها نيابة عنك على الحسابات التي تربطها، ولاستعمالها بصورة مجمَّعة غير معرِّفة لتحسين الخدمة.
• الخدمة نفسها — برمجياتها وتصميمها وعلاماتها — تبقى ملكاً لنا أو لمرخِّصينا.

6. الحسابات الاجتماعية المربوطة

• ربط حساب يفوّضنا بالنشر عليه بناءً على تعليماتك (ضغطة نشر أو خطة أنشأتها). نخزّن مفاتيح المنصات مشفّرة ولا نستعملها إلا لهذا الغرض.
• يجب أن تكون مخوَّلاً باستعمال كل حساب تربطه، وأن تلتزم بشروط كل منصة (Meta وX وتيليجرام ولينكدإن وتيك توك وغيرها).
• المنصات أطراف ثالثة مستقلة: قد تغيّر واجهاتها أو تقيّدها أو ترفض محتوى أو تعلّق حسابات، ولسنا مسؤولين عن قراراتها أو أعطالها.

7. الاستعمال المقبول

يُحظر استعمال الخدمة لإنشاء أو نشر محتوى غير قانوني أو مضلِّل أو تشهيري أو منتهك لحقوق الغير (بما فيها الملكية الفكرية) أو منتحل لشخصية أي جهة؛ كما تُحظر الحملات الآلية المسيئة والرسائل المزعجة ومحاولات الالتفاف على حدود الخدمة وحصصها التقنية. يجوز لنا تعليق أو إنهاء الحسابات المتورطة في ذلك.

8. الرسوم والتوكنات والصلاحية والاسترداد

• المزايا المدفوعة تُحاسَب عبر أرصدة توكنات مسبقة الدفع. أسعار المزايا بالتوكنات معروضة داخل الخدمة قبل كل عملية وقد تتغير بأثر مستقبلي.
• باقات التوكنات تُباع عبر شريك الدفع بصفته التاجر المسجَّل، وهو من يصدر الفاتورة ويتكفل بالضرائب المنطبقة. سعر الباقة ومدة صلاحيتها (إن وُجدت) وقاعدة الاسترداد معروضة قبل الشراء.
• أرصدة التوكنات مرتبطة بالحساب الذي اشتُريت له وغير قابلة للتحويل بين الحسابات ولا للاستبدال نقداً إلا وفق قاعدة الاسترداد.
• الاسترداد: خلال 14 يوماً من الشراء يمكنك طلب استرداد المبلغ المدفوع مخصوماً منه قيمة التوكنات المستهلَكة محسوبةً بالسعر العادي (غير المخفَّض). بعد 14 يوماً لا استرداد. التوكنات الترويجية والممنوحة بلا قيمة نقدية.
• الحصص المجانية والتجارب والمنح الترويجية يجوز تعديلها أو سحبها في أي وقت.

9. الإتاحة

نسعى لخدمة موثوقة لكننا لا نضمن تشغيلاً متواصلاً أو خالياً من الأخطاء، والنشر المجدول يعتمد على إتاحة منصات الطرف الثالث. الصيانة المخططة ومعالجة الأعطال قد تسببان توقفاً مؤقتاً.

10. الخصوصية وحذف البيانات

توضح سياسة الخصوصية ما نخزّنه ولماذا، وتوضح صفحة حذف البيانات كيفية فصل الحسابات ومحو بياناتك. حذف حسابك يمحو بياناتك الشخصية محواً فعلياً لا أرشفةً.

11. الإنهاء

• يمكنك التوقف عن استعمال الخدمة وحذف حسابك في أي وقت من الإعدادات.
• يجوز لنا تعليق أو إنهاء الحسابات التي تخالف هذه الشروط جوهرياً أو تسيء استعمال المنصات أو تشكّل خطراً قانونياً أو أمنياً — مع إشعار متى كان ممكناً بمعقولية.
• عند الإنهاء تُعامل التوكنات المدفوعة المتبقية وفق قاعدة الاسترداد في البند 8؛ والمحتوى المنشور سلفاً على حساباتك لا يتأثر.

12. إخلاء المسؤولية وحدودها

تُقدَّم الخدمة «كما هي» و«كما هي متاحة» دون ضمانات من أي نوع إلى الحد الأقصى الذي يجيزه القانون. وإلى الحد ذاته، تنحصر مسؤوليتنا الإجمالية الناشئة عن الخدمة أو المتصلة بها في المبالغ التي دفعتَها لنا خلال الاثني عشر (12) شهراً السابقة للواقعة محل المطالبة، ولا نتحمل الأضرار غير المباشرة أو العرضية أو التبعية أو العقابية، ولا خسارة الأرباح أو الإيرادات أو البيانات أو السمعة.

13. التعويض

تعوّضنا وتُخلي مسؤوليتنا عن المطالبات والأضرار والتكاليف المعقولة الناشئة عن المحتوى الذي تنشئه أو تنشره عبر الخدمة، أو عن استعمالك الحسابات المربوطة، أو عن إخلالك بهذه الشروط.

14. القانون الحاكم والنزاعات

تخضع هذه الشروط لقوانين الإمارات العربية المتحدة. وأي نزاع يتعذر حله ودياً يُحسم نهائياً بالتحكيم الملزم لدى مركز دبي للتحكيم الدولي (DIAC)، ومقره دبي، وبلغة إنجليزية.

15. تعديل الشروط ولغتها

• قد نحدّث هذه الشروط؛ التغييرات الجوهرية تُعلَن داخل الخدمة أو برسالة، واستمرار الاستعمال بعد تاريخ النفاذ يُعدّ قبولاً.
• حُرّرت هذه الشروط بالإنجليزية مع ترجمة عربية للتيسير؛ وتسود النسخة الإنجليزية عند أي تعارض.
